Agreement to Terms

By accessing or using Image to Sketch (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Image to Sketch ("Company", "we", "us", "our").

Service Description

Image to Sketch is an AI-powered image conversion service that transforms photographs and images into various artistic sketch styles, including:

• Pencil sketch drawings
• Charcoal sketch effects
• Line art and coloring book styles
• Cartoon sketch conversions
• Architectural outline drawings
• Aesthetic line sketches

Account Registration

Eligibility

To use our Service, you must:

• Be at least 13 years of age (or 16 in certain jurisdictions)
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain the security of your account credentials

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized account access
• Ensuring your account information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription Plans and Payments

Plan Types

We offer multiple subscription tiers:

• Free Plan: Limited credits with watermarked outputs
• Pro Plan: Monthly subscription with increased credits and premium features
• Max Plan: Maximum credits and fastest processing

Billing

• Subscriptions are billed on a recurring basis (monthly or annually)
• You authorize us to charge your payment method automatically
• All fees are non-refundable except as required by law or stated in our refund policy
• We use Stripe for secure payment processing

Credits System

• Each sketch generation consumes 2 credits
• Monthly subscription credits refresh at the start of each billing cycle
• Unused monthly credits expire and do not roll over
• Credit expiration dates are displayed in your account dashboard

Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will not affect your current billing cycle.

Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers.

Eligible for Refund

• First subscription purchase only (not applicable to renewals)
• Request made within 14 days of initial payment date
• Account in good standing with no policy violations
• Credits used do not exceed 80% of total monthly allocation

NOT Eligible for Refund

• Subscription renewals (only initial purchase qualifies)
• Accounts where credits have been fully exhausted
• Accounts suspended or terminated for Terms of Service violations
• Fraudulent, duplicate, or abusive refund requests
• Services provided before account closure

Refund Process

• Processing Time: Refunds processed within 5-10 business days
• Payment Method: Refunds issued to original payment method only
• One Refund Per Customer: Each customer account is eligible for one refund only
• Right to Refuse: We reserve the right to deny refund requests showing abuse patterns

Cancellation Policy

• Subscriptions can be cancelled anytime from billing settings
• Access to premium features continues until the end of current billing period
• Cancellation does not automatically trigger a refund outside the 14-day window

Acceptable Use Policy

Permitted Use

You may use the Service to:

• Convert your own images or images you have rights to use
• Create sketches for personal or commercial purposes
• Download and use generated sketches according to our Usage Rights

Prohibited Activities

You may NOT:

• Upload images you do not own or have rights to use
• Upload images containing illegal, offensive, or inappropriate content
• Upload images depicting minors in inappropriate contexts
• Use the Service to create deepfakes or misleading content
• Violate any person's intellectual property, privacy, or publicity rights
• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the Service
• Scrape, data mine, or extract data from the Service
• Resell or redistribute our Service without authorization
• Create accounts through automated means or false information
• Share account credentials with unauthorized parties

Content Restrictions

Prohibited content includes but is not limited to:

• Illegal, pornographic, or sexually explicit material
• Hateful, discriminatory, or violent content
• Content that infringes on intellectual property rights
• Malicious code, viruses, or harmful software
• Copyrighted materials without proper authorization

Violation of these policies may result in immediate account termination without refund.

Intellectual Property Rights

Your Content

• You retain all ownership rights to images you upload
• You grant us a temporary, limited license to process your images
• We automatically delete uploaded images within 24 hours
• You are responsible for ensuring you have rights to uploaded content

Generated Sketches

• You own the sketches generated from your uploaded images
• Premium users receive full commercial usage rights without attribution
• Free users receive sketches with watermarks and limited commercial rights
• You may not claim sketches were created without AI assistance where disclosure is required

Our Service

All Service components remain our exclusive property:

• Algorithms, AI models, and processing technology
• Website design, code, and user interfaces
• Trademarks, logos, and branding
• Documentation and instructional materials

You may not copy, modify, or create derivative works from our Service without written permission.

Usage Rights and Licenses

Commercial Use

• Premium Users: Full commercial rights to generated sketches without attribution
• Free Users: Limited commercial use with visible watermarks required
• You may not misrepresent sketches as non-AI-generated where disclosure is required
• You are responsible for complying with applicable disclosure laws

Restrictions

You may not:

• Sell or license access to our Service
• Use sketches to train competing AI models
• Remove or obscure watermarks on free-tier outputs
• Claim sketches as entirely human-created where AI disclosure is required

Data Privacy and Security

Data Collection

We collect and process data as described in our Privacy Policy, including:

• Account and payment information
• Uploaded images (temporarily)
• Generated sketches
• Usage analytics

Image Storage

• Uploaded images are processed and deleted within 24 hours
• Generated sketches remain in your account until you delete them
• Deleted content is permanently erased within 30 days

Security Measures

• SSL/TLS encryption for all data transmission
• Secure, encrypted server storage
• PCI-DSS compliant payment processing
• Regular security audits and updates

Service Availability

Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service access.

Maintenance

We may temporarily suspend Service for:

• Scheduled maintenance (with notice when possible)
• Emergency repairs
• Security updates
• Infrastructure improvements

Processing Times

• Free tier: Up to 60 seconds per sketch
• Pro tier: 2x faster processing
• Max tier: 3x faster with priority queue

Processing times are estimates and not guaranteed.

Limitations of Liability

Service "As Is"

The Service is provided "as is" without warranties of any kind, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

Liability Limits

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• We are not responsible for third-party content, actions, or services

User Responsibility

You are solely responsible for:

• The legality and appropriateness of uploaded content
• Compliance with applicable laws and regulations
• Any claims arising from your use of generated sketches
• Backing up important generated content

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your uploaded content
• Your use of generated sketches
• Your violation of any third-party rights
• Your breach of applicable laws

Modifications to Service and Terms

Service Changes

We reserve the right to:

• Modify or discontinue features
• Update AI models and processing capabilities
• Change credit costs or subscription pricing (with notice)
• Improve or alter the Service functionality

Terms Updates

• We may update these Terms at any time
• Material changes will be communicated via email
• Continued use after changes constitutes acceptance
• We will update the "Last Updated" date

Account Termination

By You

• You may cancel your subscription anytime from account settings
• Access continues until the end of your current billing period
• You may request account deletion through our contact page

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You upload prohibited content
• Your account shows fraudulent activity
• Required by law or legal process
• You engage in abuse or harassment

Terminated accounts are not eligible for refunds except as required by law.

Dispute Resolution

Informal Resolution

Before filing a claim, contact us at support@imagetosketch.app to resolve disputes informally. We are committed to working with you to reach a fair resolution.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver.

Assignment

You may not assign these Terms without our consent. We may assign our rights freely.
